Our client, a devoted mother and caregiver to her young daughter, faced a unique and challenging situation. Despite these connections, our client, her sole guardian, did not hold residency status, creating significant legal and logistical challenges.
The client’s case was further complicated by unresolved geopolitical issues in her home country and legal constraints on accessing her daughter’s trust funds in New Zealand. Without her mother’s residency, the trust was classified as an “overseas entity” under the Overseas Investment Act, restricting its ability to function effectively and impacting the child’s welfare.

We engaged with the Minister of Immigration directly, presenting the case as an urgent and unique matter. Our team provided a clear and concise summary of the issues, ensuring that the Minister understood the gravity and exceptional nature of the case.


Outcome
The Minister of Immigration recognised the merit of our arguments and granted a special direction to issue the client a resident visa. This decision was made just before Christmas, marking a moment of relief and celebration for the family.

- The daughter could fully access her trust funds, ensuring her long-term welfare and financial security.
